These terms govern your use of www.storygami.co, www.storygami.co.uk and www.storygami.com and any other subdomains or URLs through which we operate (Storygami), a service operated by Storygami Limited of 86-90 Paul Street, London EC2A 4NE, United Kingdom, a company registered in England and Wales (no. 08460980). Any references to ‘we’, ‘our’ or ‘us’ on this website should be read as references to Storygami Limited.
Please ensure that you have read and fully understand our Terms before signing up for and using a Storygami account. Your continued use of this website constitutes your acceptance of our Terms.
By signing up for a Storygami account you acknowledge that you are responsible for maintaining the confidentiality of your account and password and restricting access to the device/s you use to access Storygami, and to the extent permitted by law you agree that you are responsible for all activities that occur under your account. If you suspect that your account’s security has been breached, you should notify us immediately so that we can take appropriate action.
You must not use your Storygami account in any way that causes, or is likely to cause, interruption, damage or impairment to Storygami or access to Storygami or annoyance, inconvenience or anxiety to any other person. You must not (or attempt to) decompile, reverse engineer, disassemble, derive the source code of, modify or create derivative works of the Storygami service.
We reserve the right to terminate your account, refuse to provide our services for your Video, remove or edit your Layers or refuse to host your Project if you are in breach of any applicable laws or our Terms.
We own all intellectual property rights in our site and the Storygami service. Subject to our Terms, we grant you a limited, non-exclusive licence to access and use the free Storygami service for your own personal and non-commercial purposes. If you wish to use Storygami for any commercial purposes, you may sign up for our paid tiers or Enterprise services, to which these Terms also apply unless otherwise agreed by us in writing. If you are using a free account to provide commercial services, we may suspend or terminate your account at our discretion.
Each Project is comprised of the Video and the Layers. Each Layer can contain different arrangements of media, e.g. images, other videos or text (Your Content). It can also contain arrangements of other media which is not owned by you, e.g. maps or links to or excerpts from social media profiles (Third Party Content).
You will always retain ownership of your Video and Your Content, but you acknowledge that by importing a Video and/or uploading Your Content into Storygami, you grant us a limited, worldwide, non-exclusive, royalty-free licence and right to copy, transmit, distribute, archive, publicly perform and display (through all media currently known or created in the future) and make derivative works from the Layers, your Video or Your Content in order to:
If you are an Enterprise user, we will not use your Project for promotional purposes without your prior agreement. The licences granted by you will continue until you remove Your Content or the relevant Project from Storygami, except in the case of archival and preservation for legal proceedings, disputes and investigations in which case the licences will continue indefinitely.
When importing a Video into Storygami, you warrant that you have the permissions and/or rights to do so. When uploading Your Content to Storygami, you warrant that it does not infringe any third party’s intellectual property or privacy rights, contain any hateful, defamatory, derogatory, discriminatory, sexually explicit material or other material which could cause harassment or hatred towards any individual or group, or depict any unlawful, overly violent or explicit behavior, cruelty towards animals, exploitation of children or minors or violates any law. If you discover that your Video, Your Content or the Project is infringing on the intellectual property rights of any third party, you should immediately delete Your Content from the Project, or the entire Project. We may suspend or terminate accounts for posting infringing material (see paragraph 7 below for details).
You further represent and warrant that you have the right to submit Your Content to Storygami and the right to grant the licences mentioned above and that Storygami will not be required to obtain licences from any third party or pay royalties to any third party in connection with Your Content.
You agree to indemnify us against all claims, liabilities and expenses arising out of any claim that the Video or Your Content infringes the rights of any third party in any territory. Any indemnity you provide to us under these terms and conditions only applies to the extent that we promptly notify you in writing of any claim or lawsuit relevant to the indemnity, and we will make no admissions or settlements without your prior written consent.
You remain responsible for keeping local backups or copies of your Video and Your Content and you should not regard us as a backup service. We attempt to maintain an uptime of 99.8%. However, due to circumstances that are sometimes beyond our control, interruptions to our services may occur (e.g. through network failures or other external factors).
To the extent permissible by law, we shall not be liable for any direct loss, indirect loss, consequential loss or other damages resulting from any disruptions to any of our services, or as a result of any act or omission by us arising out of or in connection to your use or access to (or inability to use or access) Storygami.
We currently support the newest versions of all modern HTML5 browsers including Chrome, Safari (6.1+), Firefox, Opera and Internet Explorer (11+). While we aim to support most modern mobiles and tablets we cannot guarantee compatibility. You are encouraged to test your Project on a variety of browsers and devices as we are not liable for any losses you may suffer if a user’s browser or device is unable to correctly display a Project. If you are a free user you acknowledge that our service is being offered free of charge on an ‘as-is’ basis and we offer no warranties, express or implied.
We do not screen or monitor any Videos, Your Content or Third Party Content displayed in a Project (together Content) and are therefore not responsible for any Content. If we believe or are notified that any Content infringes on the rights of a third party or otherwise breaches these Terms, we may disable that Project or the account associated with it while we investigate the situation and we reserve the right to remove that Project entirely and suspend/terminate the account associated with it if these Terms have been breached. We can be notified of any infringing material here.
If you have a free account, we reserve the right to terminate your access to all or any part of Storygami at any time, with or without cause, with or without notice and effective immediately.
If you have a paid account or a Enterprise level account, we will only terminate your account without notice if you materially breach these Terms and do not remedy the breach within 14 days of being notified by us of the breach. Our total liability to you shall not exceed the amounts paid by you to us over the twelve months preceding any claim you may make.
You agree to our Fair Use Policy and acknowledge that we may suspend or terminate your account if you breach it.
If you have a free account, your Project will prominently display the Storygami branding and may overlay Content. If you have a paid or an Enterprise level account, our branding will be more subtly placed and will not overlay any Content. For Enterprise level accounts, we may agree to remove our branding entirely with prior agreement. Where applicable, you agree not to interfere with or otherwise prevent our branding from being displayed in any Project.
Paid accounts each require a minimum commitment period of 1 month minimum. You acknowledge that all fees are levied entirely by Storygami and neither YouTube or any other video service receive any portion of our fees. Our current pricing is available on our plans page.
Payments will be charged on the day you sign up for the paid or Enterprise level account and will cover the use of that service for a monthly or annual subscription period as indicated. Sign up fees are not refundable (except in accordance with our refund policy) and unless you notify us before the end of the indicated subscription period, we will automatically renew your subscription and you authorise us to collect the annual or monthly subscription rate applicable at that date using any payment mechanism we have on record for you. You can cancel auto-renewal via the Storygami user menu.
Any failure by us to insist upon or enforce any provision of these Terms shall not be construed as a waiver of any of our rights. If any one of these terms is declared invalid by a court, this will not affect the validity of the remaining terms. In these Terms, the singular includes the plural and vice versa.
Data is collected by Storygami Limited, a company registered in England and Wales (no. 08460980) of 86-90 Paul Street, London, EC2A 4NE, United Kingdom. Any references to ‘we’, ‘our’ or ‘us’ in this policy should be read as references to Storygami Limited. By submitting your personal information to us, you consent to the use of that information as set out in this policy.
When you register for our service we may collect your name or company name, address, location, email address, telephone number, credit or debit card number and expiry date, PayPal or Stripe account details.
We use this information to process your registration, provide our service, process payments, provide statements of account and communicate with you on any matter relating to your account and the provision of our service in general.
We may also use aggregate information and statistics for the purposes of monitoring website usage in order to help us further develop and improve our service, and may provide the aggregate information and statistics to third parties. These statistics will not include any information which can be used to identify you.
We may also wish to provide you with information about special offers related to our service or any other service or products which we think may be of interest to you. If you would rather not receive this information, please opt-out by contacting us here.
Cookies are text files stored on your device which allow us to track and identify our visitors, their usage of the site and website preferences. You can configure your device not to accept our cookies if you wish, although certain features of our site may not work if you do this.
We have in place SSL from Digicert and encourage users to use secure passwords. We will use all reasonable efforts to safeguard your personal information, but you should be aware that the Internet is not secure and so we cannot guarantee the security or integrity of any personal information transferred from or to you through your use of this service.
The information you provide to us may be transferred to countries outside the European Economic Area (EEA) that do not have similar protections in place as set out in this policy. We will nevertheless take all steps to ensure the security of your information. The EEA comprises the EU member states plus Norway, Iceland and Liechtenstein.
You have the right to request a copy of the information we hold about you. If you would like a copy of some or all of your personal information please contact us here or send a letter to the address above. We may make a small charge for this service.
If any of the information you have provided to us changes, you can update it through your account. You may ask us, or we may ask you, to correct information you or we think is inaccurate, and you may ask us to remove information which is inaccurate.
If our business is sold or integrated with another, your details may be disclosed to our advisers and any prospective purchasers and their advisers and will eventually be passed on to the new owners of the business.
While we love nothing more than seeing our users make a lot of amazing Storygami videos that become very successful we have to set some limits. If you make more than 365 basic videos in a year (one video per day) we may start to wonder if you are the only one person using your account and we may suspend or disable your account while investigating the matter and discussing options with you.
If we find that you use our free account for commercial videos we may also ask that you upgrade to a paid tier that would suit your needs a bit better and we may disable your account unless you wish to do so.
While we allow unlimited views for your interactive videos and we wish to keep it that way we reserve the right to add a cap on the amount of views and will inform you if we notice that your videos are receiving so many views that we feel that we can no longer maintain your video and content for free.
You have the right to ask for a refund within 30 days of signing up. The paid videos created with this subscription will automatically be disabled and your embed code will no longer work. If we find that your interactive video has been published and has received views then we may at our discretion refuse a refund due to the rewards of using our paid accounts.
You can continue using our free account for free after a refund.
